View AnswerYes, the Consumer Wheelchair Repair Bill of Rights in New York applies to complex power mobility devices.
Under this legislation, New York residents who own or lease a wheelchair—whether it is a manual chair or a complex power wheelchair—are protected. The law ensures that manufacturers cannot restrict repair access and must provide necessary support for these advanced devices.
Key protections for complex power wheelchair users include:
- Access to Parts and Tools: Manufacturers must supply repair parts, diagnostic tools, and software to both consumers and independent repair shops.
- 10-Day Repair Window: The law establishes a clear maximum repair time of 10 days for covered repairs, reducing the lengthy wait times often associated with specialized equipment.
- Firmware and Manuals: Manufacturers are required to provide access to firmware updates, diagnostic software, and comprehensive service manuals to qualified providers.
- Insurance Coverage: These rights apply regardless of your insurance provider. For instance, if you use Power Wheelchair Medicare funding for your complex device, you are still fully covered by the Bill of Rights.
